Deeds Section

Preparation of demand notices to enable offerees pay service charge

The following are the processes involved

  • Client waits for approval in the PWDRE meeting
  • Client is given notice of 21 days to make payment

The service provision time frame is 1 day and the applicable fee is k350. The customer is required to collect the demand notice.

Preparation of Recommendations for submission to the Ministry of lands

The following are the processes involved are:

  • Client waits for Council approval of the request made
  • Client recommended after presentation of payment receipt

The service time frame is 3 days and there are no attached fees. The Customer needs to present a payment receipt

Recommendation to Ministry of Lands (Formalization of land)

The following are the processes involved:

  • Application to be submitted addressed to the Town Clerk
  • Reported in the PWDRE
  • Full Council adoption/rejection
  • Copies of Minutes
  • Site plan.

The Service timeframe is minimum 3 months and the chargeable fees are as follows:

  • Customers without plot numbers: K300.00
  • Customers with plot numbers: Free
  • Service charge: K4,400.00
  • Site plan: K500.00
  • Preparation of minutes: K50.00

The requirements are:

  • Proof of how the parcel of land was obtained
  • Fill in affidavit form as proof of ownership
  • Make payment
  • Present payment receipt
  • File submitted to Ministry of Lands
  • Offer Letter submitted to Council for exact location of land to be shown.

Conducting file search for Clients

The following are the processes involved

  • File search done after client presents payment receipt.

The service time frame is 1 day (Fridays: 09:00hrs – 12:30hrs) and the chargeable fee is k50.00. The customer needs to present a proof of payment (receipt).

Change of ownership

The following are the processes involved

  • Application to be submitted.
  • Application reported in the PWDRE meeting.
  • Full Council adoption/rejection.

The service provision time frame is minimum 3 months, with a conveyance fee of k3,000.00. The following are the customer requirements:

  • Ensure the seller of land has proof of ownership
  • A Title Deed for the property
  • A Letter of Offer from the Ministry of Lands
  • Signed documents from the Council
  • A Sale Agreement Letter
  • Pay a fixed charge to the Council indicated in the letter for transfer of property
  • Obtain and complete Change of Ownership forms from Deeds Registry
  • Submit a copy of DCE ZRA PTT Certificate
  • Submit a copy of Title Deed and ZRA Property Transfer Tax Certificate

Revocation of recommendation

The following are the processes involved

  • Application to be submitted.
  • Application reported in the PWDRE meeting.
  • Full Council adoption/rejection.

The service provision time frame is minimum 3 months, with a conveyance fee of k3,000.00. The following are the customer requirements:

  • Ensure the seller of land has proof of ownership
  • A Title Deed for the property
  • A letter of Offer from the Ministry of Lands
  • Signed documents from the Council
  • A Sale Agreement Letter
  • Pay a fixed charge to the Council indicated in the letter for transfer of property

Conversion of customary land to state land

The following are the processes involved:

  • Application to be submitted
  • Application reported in the PWDRE meeting
  • Full Council approval
  • Copies of Minutes
  • Site plan (From Ministry of Agriculture)

The service time frame is and the chargeable amount is k500 per application ( For application form). The requirements are:

  • NRC
  • 3 passport size photos
  • Payment receipt
  • File submitted to Ministry of Lands
  • Offer letter submitted to Council for exact location of land to be shown

Licensing Section

Issuance of Liquor License

The following are the processes involved

Council advertises for renewal or grant of Liquor Licenses

  • Applicants fill in a standard application form obtained from the Council
  • Inspection of the premises by Public Health Inspectors and Fire Brigade Officers
  • Building Inspection
  • Submission of the applications to the Liquor Licensing Committee
  • Liquor License granted or renewed (if satisfied with inspection).

The Service provision time frame is 90 days and the fees are as follows:

  • K30.00 (Application form fee)
  • K360.00 (for a Club)
  • K240.00 (Bar, Retail and Wholesale outlets)

Litigation Section

Registration of Caveats/Mortgages

The following are the processes involved:

  • Collection of caveat forms from the Court
  • Visit Council (Litigation section)

The service provision time frame is 1 day and the applicable fee is k500. The requirements are:

  • Original and photocopy of NRC
  • Caveat form from the Court

Prosecution

Prosecution is tasked with representing the council in the courts of law

Contracts Section

Preparation of Contracts

  • The Contracts section Prepares contracts between the council and various contractors such as construction companies and suppliers on behalf of the institution.
  • It is also responsible for reviewing contracts that are given to the institution by other service providers
